Terms of service
These terms govern the services provided by RB Growth Engine, a sole proprietorship of Ramon S. Barredo II, based in Huntington Beach, California ("we", "us"). They apply when you engage us as a client ("you"). Your signed proposal or written engagement, if we have one, sits on top of these terms and wins wherever the two disagree.
What we do
RB Growth Engine builds and operates a done-for-you client-acquisition system. Depending on what you engage us for, that can include outbound email infrastructure, lead data, campaign operations, CRM setup, reply handling, paid social management, and ongoing monitoring. The specific scope for your business is agreed in writing before work begins.
Fees and billing
Services are provided on a monthly retainer, billed in advance for the month ahead. Invoices are issued through GoHighLevel and processed by Stripe.
- Invoices are due on receipt unless your engagement says otherwise.
- If you are enrolled in auto-pay, the card or bank account on file is charged on the invoice date.
- Third-party costs passed through to you — ad spend, data, software seats, domains — are either billed at cost or paid by you directly, as agreed in writing.
- If an invoice goes unpaid, we may pause work until it is settled. We will tell you before we do.
Cancellation
Either of us may end the engagement with 30 days' written notice by email. Work continues and fees remain payable through the notice period. Fees for the current month are not refunded, since the month's work is scheduled and largely performed in advance. On termination we will hand over your accounts, lists, and data in a usable format.
What we need from you
The system only works if the inputs are sound. You agree to:
- Give us accurate business information, and tell us promptly when it changes.
- Provide only lists and contact data you have the legal right to use.
- Comply with the laws that govern your own marketing — including CAN-SPAM, the TCPA, and applicable state privacy and telemarketing rules — and honor opt-outs and do-not-contact requests.
- Review and approve campaign copy, offers, and claims before they go out. You are responsible for the accuracy of statements about your own business.
- Respond to leads we route to you. We can fill the pipeline; we cannot answer your phone.
If you ask us to run something we believe is unlawful or likely to get your domains or numbers blocked, we will say so and may decline to run it.
No guarantee of results
We do not promise a specific number of leads, appointments, sales, or any particular return. Outcomes depend on your market, offer, pricing, sales follow-through, and factors outside anyone's control. Nothing on this site or in our conversations is a guarantee of performance.
Ownership
You own your business data, your customer and lead lists, your accounts, and the domains and content we set up on your behalf. We own our methods, templates, frameworks, scripts, tooling, and the general knowledge and experience we bring — including anything we develop while working with you that is not specific to your business. We may describe the work at a general level as a case study or reference; we will ask before using your name or logo.
Confidentiality
We keep your non-public business information confidential and use it only to do the work, and we expect the same of you regarding our proposals, pricing, and methods.
SMS / text messaging
RB Growth Engine sends transactional and account-related text messages — invoice notices, payment reminders, receipts, and appointment or service updates — to clients who have given us their mobile number and consented to receive them.
Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out at any time. Reply HELP for help, or contact us at rb112278@gmail.com.
Consent to receive text messages is not a condition of any purchase.
Mobile information is never shared with third parties or affiliates for marketing or promotional purposes. How we handle your information is described in our privacy policy.
Limitation of liability
To the fullest extent the law allows, our total liability arising out of or relating to these terms or our services is limited to the fees you paid us in the three months before the claim arose. We are not liable for lost profits, lost revenue, lost data, or indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited by law.
Third-party platforms
Our work runs on platforms we do not control — email providers, CRM software, ad networks, data vendors. Their outages, policy changes, and account decisions are outside our control, and we are not responsible for them. We will work with you to adapt when they happen.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and we both consent to that jurisdiction. Before filing anything, we agree to spend 30 days trying to work it out directly.
Changes to these terms
We may update these terms; the effective date at the top will change. If a change materially affects a current engagement, we will tell you by email before it applies to you.
